Landlords participating in the Housing Choice Voucher program operate in the same way as a landlord in the private rental market. The owner must sign a lease (can be month to month) with the HCV recipient. A principle benefit to the landlord for participating in the programs is that the federal government guarantees a portion of the rent.

SCMMCHRA would like to alert you that there are revisions to the state statute regarding late fees and holding abandoned property.
Sec. 5. [504B.177] LATE FEES.
Effective January 1, 2011, for leases entered into or renewed on or after that date:
- Late fee must be provided for in writing in order to be enforceable.
- Late fee amount is limited to 8% of the overdue rent payment.
- Date for early payment discount is not considered the "due date".
- This law excludes late fees provided for in federal statutes, regulations, or handbooks for federal subsidy programs from the 8% limitation.
Sec. 8 Minnesota Statutes 2008, section 504B.271, subdivision 1 ABANDONED PROPERTY:
Effective August 1, 2010:
- Amount of time the landlord is required to hold abandoned personal property is reduced from 60 days to 28 days.
- The 14-day notice and posting of notice is only necessary if the landlord will sell the property.
- Punitive damages have increased for a landlord failing to allow a tenant to retake possession of abandoned property.
- In all judicial districts the court hearing the eviction action retains jurisdiction in matters relating to removal of personal property.
